In a major blow to Donald Trump’s immigration agenda, a federal judge has blocked the president’s executive order that aimed to deny asylum access to migrants crossing the southern border.

U.S. District Judge Randolph Moss ruled that the order, which Trump issued in January 2025, violated both federal law and the Constitution. The decision imposes a nationwide injunction, halting the enforcement of the policy—though the judge allowed a 14-day delay to give the Trump administration time to appeal.

In a detailed 128-page ruling, Judge Moss made it clear: only Congress has the authority to regulate asylum, not the president. The Trump administration had attempted to create an “alternative asylum system” that barred anyone crossing the border outside legal ports of entry from requesting protection in the U.S.

But according to Moss, this move directly violated the Immigration and Nationality Act (INA), which guarantees the right to seek asylum to anyone physically present in the country, regardless of how they entered.

“The Executive Branch may not override the law simply by executive proclamation,” Moss wrote.


🛑 Nationwide Injunction – But With Delay

The ruling takes effect in 14 days, unless a higher court intervenes. If no appeal succeeds, asylum seekers will regain access to the process, even if they cross the border illegally.

This pause gives the Trump administration a small window to request an emergency stay from the D.C. Circuit Court of Appeals.
